The Cool Venue Affiliate Program – Terms & Conditions

Welcome to The Cool Venue Affiliate Program (“Program”). By participating in this Program, you (“Affiliate”) agree to the following Terms and Conditions (“Terms”). Please read them carefully.

1. Introduction

By enrolling in the TCV Affiliate Program, you agree to be bound by these Terms. TCV (“The Cool Venue”, “we”, “us”, “our”) reserves the right to modify or update these Terms at any time. Your continued participation constitutes acceptance of any changes.

2. Eligibility

Age & Residency: You must be at least 18 years old and legally able to enter into a contract.

Application Approval: Enrollment is open only to individuals who submit an application and are approved by TCV.

Local Focus: This Program is designed for affiliates who can effectively promote local events and our venue. We reserve the right to decline or terminate participation if your promotions do not align with our guidelines.

3. Affiliate Obligations

Accurate Representation: You must represent The Cool Venue professionally and only use approved marketing materials and strategies.

Prohibited Practices: You are prohibited from engaging in fraudulent or unethical practices (e.g., spamming, misleading advertising, or misrepresenting our brand).Confidentiality: Maintain the confidentiality of your unique affiliate link or code. Any misuse or unauthorized sharing may lead to termination.

Compliance: Adhere to all applicable laws, including proper disclosure of your affiliate relationship in your promotional activities.

4. Commission Structure & Payment

Commission Earned: Affiliates earn commissions for qualified bookings generated via your unique affiliate link or code, as defined in the Program guidelines.

Calculation & Adjustments: Commissions are based on verified bookings. Any cancellations or refunds may result in commission adjustments.

Payment Schedule: Payments will be made on a [monthly/bi-monthly] basis via [specified payment method, e.g., PayPal or bank transfer] once you meet the minimum payout threshold.

Withholding & Disputes: We reserve the right to withhold commission payments in the event of suspected fraud or disputes pending resolution.

5. Tracking & Attribution

Unique Identifier: Your unique affiliate link or code is required for tracking referrals. You are responsible for ensuring its proper use.

Attribution: We use tracking cookies and other technologies to attribute referrals accurately. In cases of technical errors, TCV is not liable for any lost commissions.

Manual Attribution: If a referral is not automatically tracked, you must notify TCV immediately for a manual review.

6. Term & Termination

Voluntary Participation: You may terminate your participation at any time by providing written notice to TCV.

TCV’s Right to Terminate: We reserve the right to suspend or terminate your participation, with or without cause, at our discretion.

Post-Termination: Upon termination, you must cease using all TCV marketing materials and remove your affiliate link. Pending commissions for referrals made prior to termination will be paid as per our standard procedures.

7. Limitation of Liability & Indemnification

Limitation: TCV is not liable for any indirect, incidental, or consequential damages arising from your participation in the Program.

Indemnification: You agree to indemnify and hold harmless TCV, its affiliates, and its directors, officers, employees, and agents from any claims, losses, or damages resulting from your actions or breach of these Terms.

8. Modification of Terms

Right to Change: TCV may update these Terms at any time by posting the revised version on our website or sending a notification via email.

Continued Participation: Your ongoing participation in the Program after any modifications signifies your acceptance of the new Terms.

9. Governing Law & Dispute Resolution

Governing Law: These Terms are governed by and construed in accordance with the laws of [Insert State/Country].
